  1. LEMON LAW (WARRANTY) LETTERS
     
    1. NOTICE OF REPEATED DEFECTS - If your vehicle has had a defect that resulted in a condition that would likely cause serious bodily injury in the first 18,000 miles/18 months (which ever occurs first) at least once OR your vehicle has the same defect repaired twice that substantially affects the safety, use, or value of vehicle in the first 18,000 miles/18 months (which ever occurs first) send the manufacturer this letter. The manufacturer must print an address in your owner's manual telling you where to send this notice in order to be legally entitled to receive this notice from you.

    2. 30 DAY NOTICE FOR REPLACEMENT OR RESTITUTION - Use this letter when you are making a GENERAL WARRANTY claim OR seeking to use the SPECIAL LEMON LAW PRESUMPTION. By sending the manufacturer this letter you a putting it on notice that their vehicle is a "lemon" and their failure to act may deemed "willful" and expose them to a civil penalty. Your owner's/warranty manual will have an address where you can send it. It is recommended you send this letter by certified mail or other confirmed delivery system.

    3. REQUEST FOR ARBITRATION - Use this letter when you are making a request for arbitration. It is important to notify both the manufacturer and the arbitration program about your dispute. The owners manual will have an address where to contact the manufacturer. You can obtain the initial contact information for the Certified Arbitration Program from the Department of Consumer Affairs Website. It is recommended you send this letter by certified mail or other confirmed delivery system.
