4. USED CARS SOLD "AS IS" HAS ITS LIMITS - PART 1
"AS IS" IS NOT A LICENSE TO STEAL; MANY USED CAR'S COMPONENTS MUST WORK WHEN SOLD
Used Cars more than 10 years old or with high mileage are almost always sold "AS IS". Meaning you have NO implied/express warranty and YOU
MUST pay for any repairs. BUT there are many car components that must be inspected/repaired prior
to sale. And selling the vehicle "AS IS" does not relieve the dealer of insuring this equipment in proper working order:
EMMISSION CONTROLS: California requires ANYBODY (not just used car dealers) to only sell a used car which will pass the California Smog Check. Dealers must
sell a used car with a valid Smog Certificate. In many instances dealers take shortcuts in getting a smog certificate issued and any used car buyer has
a right to have the emmission controls repaired so a Smog Certificate can be properly issued. In many instances defective emmission controls adversely
affect a vehicle's performance/drivability so repairs solve both problems.
SAFETY ITEMS: California requires dealers who sell a used car at retail to only sell vehicles that fully comply with all the requirements of the
California Vehicle Code. This means that the brakes, steering, suspension, lights, windshield, tires, and other typical safety related items must work. A buyer
has the right to make the dealer pay to repair any of these items that are not in compliance with California's Vehicle Code.
ODOMETER: The odometer must be working and an accurate odometer disclosure given to a buyer.
Reputable used car dealers conduct a thorough inspection of all required vehicle equipment prior to placing them on their lots. In the jargon of the
automotive business this is referred to as a "smog and safety".
