4. NON-BINDING ARBITRATION

WHAT IS THE ARBITRATION PROCESS: This process is a hearing conducted by qualified neutral 3rd persons to determine if the buyer's vehicle qualifies as "lemon" under the SPECIAL "LEMON" PRESUMPTION. This process must be entirely maintained and paid for by the manufacturer. If the buyer doesn't like the decision the buyer can reject the decision and then file suit. If the buyer accepts the decision the manufacturer must comply with the decision within 30 days.

HOW LONG THE ARBITRATION PROCESS TAKES: The arbitration program must reach a decision within 40 DAYS of being notified of a dispute and may take an additional 30 DAYS to have your vehicle inspected. We recommend that you notify the manufacturer and the arbitration program simultaneously and have a INTERACTIVE FORM LETTER in our self-help section to accomplish this.

REMINDER- Everything discussed here ONLY applies if the buyer intends to use the SPECIAL PRESUMPTION. This is NOT required if the buyer is only proceeding under the general "Lemon Law" discussed in Part 1.
